These Terms and Conditions ("Terms") govern your use of the Ashhkaro mobile application (the "App") operated by Ashhkaro("we", "us", or "our"). Ashhkaro is a marketplace that connects customers with local businesses for booking services and offers savings plans and business listings. By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility and Accounts
You must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction, you should use the App only with the involvement of a parent or guardian. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for all activity that occurs under your account.
2. Our Role as a Marketplace
Ashhkaro is a platform that connects customers with independent vendors (businesses). We are not the provider of the services listed by vendors and we do not perform those services. Any booking or transaction is an agreement between the customer and the vendor. We are not responsible for the quality, safety, timing, or legality of the services provided by vendors.
3. Bookings and Appointments
When you book an appointment, the price, discount and details shown at the time of booking apply. Vendors may confirm, reject, or reschedule appointments, and customers may cancel subject to the vendor's terms. You agree to provide accurate booking information and to honor confirmed appointments.
4. Vendor Responsibilities
If you list a business on the App, you agree that:
- Your business information, services, prices and availability are accurate and kept up to date;
- You have the legal right to offer the services you list and will comply with all applicable laws and regulations;
- Any information you upload (such as business images, logos or product photos) is accurate and does not infringe the rights of others;
- You will honor bookings and the prices and discounts you publish.
5. Payments, Subscriptions and Listings
Payments for subscriptions, memberships, business listings, and other paid features are processed by our third-party payment provider (PayFast). By making a purchase, you authorize the applicable charge. Subscriptions and listings are valid for the period stated at the time of purchase. Unless required by law or stated otherwise, payments are non-refundable. Prices are shown in Pakistani Rupees (PKR).
6. Reviews and User Content
You retain ownership of content you submit, such as reviews, ratings, images, and business details. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content for the purpose of operating and promoting the App. You are responsible for your content and must not post anything unlawful, misleading, offensive, or that infringes the rights of others.
7. Prohibited Conduct
You agree not to:
- Use the App for any unlawful or fraudulent purpose;
- Provide false identity, business, or payment information;
- Post fake reviews or manipulate ratings;
- Attempt to gain unauthorized access to the App or other accounts;
- Interfere with or disrupt the App or its infrastructure;
- Upload viruses or any other malicious code.
8. Intellectual Property
The App and its content, features, and functionality (excluding user-submitted content) are owned by Ashhkaro and its licensors and are protected by applicable laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our prior written consent.
9. Termination
We may suspend or terminate your access to the App at any time, without prior notice, if you breach these Terms, provide false information, or misuse the platform. You may stop using the App and request account deletion at any time.
10. Disclaimer
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free, or that vendors or customers will meet their obligations.
11. Limitation of Liability
To the maximum extent permitted by law, Ashhkaro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any disputes, services, or transactions between customers and vendors arising out of or related to your use of the App.
12. Governing Law
These Terms are governed by the laws of Pakistan, without regard to its conflict of law provisions. Any disputes shall be subject to the courts of Pakistan.
13. Changes to These Terms
We may revise these Terms from time to time. The most current version will always be posted on this page. By continuing to use the App after changes become effective, you agree to the revised Terms.
